Policy and Procedure for Preventing and Addressing Sexual Harassment

1. Purpose

Brain Factor Mexico is committed to providing a safe, respectful, and harassment-free workplace for all employees, clients, and partners. This policy ensures that cases of sexual harassment are addressed promptly, confidentially, and effectively.

2. Objectives

  • To prevent sexual harassment in the workplace.
  • To protect victims of harassment throughout the investigation and resolution process.

  • To establish a structured procedure for reporting, investigating, and addressing sexual harassment.

3. Scope

This policy applies to all employees, contractors, clients, and third parties interacting with Brain Factor Mexico in any capacity.

4. Definitions

Sexual harassment includes any unwanted conduct of a sexual nature, whether verbal, physical, or non-verbal, that creates an intimidating, hostile, or offensive environment. Examples include:

  • Unwelcome advances, comments, or physical contact.
  • Display of offensive images or materials.
  • Any action affecting employment conditions or dignity in the workplace.

5. Reporting Procedure

5.1 Submitting a Complaint

Victims or witnesses of harassment may submit a formal complaint to the Intervention Committee Against Sexual Harassment via the following channels:

The Intervention Committee will:

  • Receive and acknowledge complaints promptly.
  • Provide protective measures to ensure the victim’s safety and well-being.
  • Conduct a fair, impartial, and confidential investigation.
  • Issue recommendations for sanctions or additional measures to prevent recurrence.

5.3 Investigation Process

  • Initial Assessment: The Committee evaluates the submitted complaint within 2 working days.
  • Confidential Investigation: Interviews and evidence gathering are conducted while ensuring anonymity for all parties involved.
  • Resolution and Sanctions: The Committee issues a report recommending appropriate sanctions or corrective measures.

6. Sanctions and Preventive Measures

Individuals found guilty of sexual harassment may face disciplinary actions, including but not limited to:

  • Formal warnings
  • Suspension without pay
  • Termination of employment or contract
  • Legal action where applicable

Preventive measures may include:

  • Mandatory awareness and sensitivity training for all employees.
  • Regular monitoring and workplace climate assessments.

7. Confidentiality and Protection

All investigations will remain strictly confidential. Brain Factor Mexico will ensure no retaliation against victims, complainants, or witnesses.

Brain Factor Mexico will conduct regular training sessions to educate employees on:

  • Recognizing and preventing sexual harassment.
  • The process for reporting and addressing complaints.

9. Intervention Committee

Brain Factor Mexico has established a Committee Against Sexual Harassment, responsible for handling all complaints and ensuring compliance with this policy. The Committee comprises trained, impartial representatives, ensuring professionalism and fairness throughout the process.
